IN THE THIRD JUDICIAL CIRCUIT OF FLORIDA

2009-007

IN RE:APPLICATION OF FUNDS RECEIVED IN CRIMINAL CASES

WHEREAS, Florida statutes provides for a myriad of mandatory and discretionary fees, costs, fines, and restitution to be applied in criminal cases; and

 

WHEREAS, Florida statutes sets the payment priority of some, but not all, of the mandatory and discretionary fees, costs, fines and restitution; and   

 

WHEREAS, there is a necessity to promulgate and establish an order of priorities for payment of fees, costs, fines, and restitution.

 

NOW, THEREFORE, pursuant to the authority conferred by Florida Rules of Judicial Administration 2.215, it is ORDERED as follows:

 

The order in which monetary payments arc to be distributed are as follows:

  1. Public Defender Application Fee
  2. Restitution
  3. Fines
  4. Court Costs
  5. Public Defender Fees
  6. Cost of Prosecution
  7. Cost of Supervision
  8. Cost of Incarceration
