WHEREAS, the Supreme Court of the State of Florida issued AOSC-11-44 terminating the statewide managed mediation program for residential mortgage foreclosure cases effective December 19, 2011, and

WHEREAS, Administrative Order # 2010-003 of the Third Judicial Circuit implemented the Residential Mortgage Foreclosure Mediation program in the Third Judicial Circuit of Florida;

NOW, THEREFORE, IT IS ORDERED:

1. Administrative Order # 2010-003 of the Third Judicial Circuit is hereby rescinded as of December 19, 2011.
2. All cases which were subject to Administrative Order # 2010-003 that were filed before December 19, 2011 shall continue to be subject to the requirements of said order.
3. Any residential mortgage foreclosure cases filed on or after December 19, 2011, and before the date of this order are exempt from the mandatory managed mediation program and the requirements of Administrative Order # 2010-003.
4. Nothing in this order prohibits any judge presiding over a residential mortgage foreclosure case in the Third Judicial Circuit from referring any such case to mediation on a case-by-case basis.
